# §8906a. Temporary employees

- (a)
  - (1) The [Office](/usc/5/5402.md?p=3) of Personnel Management shall prescribe regulations to provide for offering [health benefits plans](/usc/5/8901.md?p=6) to temporary [employees](/usc/5/4701.md?p=a-2) (who meet the requirements of [paragraph (2)](#a-2)) under the provisions of this chapter.
  - (2) To be [eligible](/usc/5/4701.md?p=a-3) to participate in a [health benefits plan](/usc/5/8901.md?p=6) offered under this section a temporary [employee](/usc/5/4701.md?p=a-2) shall have completed 1 year of current continuous employment, excluding any break in [service](/usc/5/8401.md?p=26) of 5 days or less.
- (b) Notwithstanding the provisions of [section 8906](/usc/5/8906.md)—
  - (1) any temporary [employee](/usc/5/4701.md?p=a-2) enrolled in a [health benefits plan](/usc/5/8901.md?p=6) under this section shall have an amount withheld from the [pay](/usc/5/7511.md?p=a-4) of such [employee](/usc/5/4701.md?p=a-2), as determined by the [Office](/usc/5/5402.md?p=3) of Personnel Management, equal to—
    - (A) the amount withheld from the [pay](/usc/5/7511.md?p=a-4) of an [employee](/usc/5/4701.md?p=a-2) under the provisions of [section 8906](/usc/5/8906.md); and
    - (B) the amount of the [Government](/usc/5/4101.md?p=3) contribution for an [employee](/usc/5/4701.md?p=a-2) under [section 8906](/usc/5/8906.md); and
  - (2) the employing [agency](/usc/5/3132.md?p=a-1) of any such temporary [employee](/usc/5/4701.md?p=a-2) shall not [pay](/usc/5/7511.md?p=a-4) the [Government](/usc/5/4101.md?p=3) contribution under the provisions of section 8906.
