# §6365. Contributions of annual leave

- (a)
  - (1) An [employee](/usc/5/6301.md?p=2) may, by written application to the [Leave Bank](/usc/5/6361.md?p=3) [Board](/usc/5/8401.md?p=5), request that a specified number of hours be transferred from the annual leave [account](/usc/5/8401.md?p=1) of such [employee](/usc/5/6301.md?p=2) to the [leave bank](/usc/5/6361.md?p=3) established by such [agency](/usc/5/3132.md?p=a-1).
  - (2) An [employee](/usc/5/6301.md?p=2) may [state](/usc/5/8521.md?p=a-3) a concern and desire to aid a specified proposed [leave recipient](/usc/5/6361.md?p=5) or a [leave recipient](/usc/5/6361.md?p=5) in the application filed under [paragraph (1)](#a-1).
- (b)
  - (1) Upon approving an application under [subsection (a)](#a), the employing [agency](/usc/5/3132.md?p=a-1) of the [leave contributor](/usc/5/6361.md?p=4) may transfer all or any part of the number of hours requested for transfer, except that the number of hours so transferred may not exceed the limitations under [paragraph (2)](#b-2).
  - (2)
    - (A) In any one leave year, a [leave contributor](/usc/5/6361.md?p=4) may contribute no more than a total of one-half of the amount of annual leave such contributor would be entitled to accrue during the leave year in which the contribution is made.
    - (B) A [leave contributor](/usc/5/6361.md?p=4) who is projected to have annual leave that otherwise would be subject to forfeiture at the end of the leave year under [section 6304(a)](/usc/5/6304.md?p=a) may contribute no more than the number of hours remaining in the leave year (as of the date of the contribution) for which the [leave contributor](/usc/5/6361.md?p=4) is scheduled to work and receive [pay](/usc/5/7511.md?p=a-4).
- (c) The [Leave Bank](/usc/5/6361.md?p=3) [Board](/usc/5/8401.md?p=5) of a [leave contributor](/usc/5/6361.md?p=4) may waive the limitations under [subsection (b)(2)](#b-2). Any such waiver shall be in writing.
- (d) The [Office](/usc/5/5402.md?p=3) of Personnel Management shall prescribe regulations establishing an open enrollment period during which an [employee](/usc/5/6301.md?p=2) may contribute leave under [subsection (a)](#a) for a leave year.
