# §6364. Establishment of Leave Bank Boards

- (a)
  - (1) Each [agency](/usc/5/3132.md?p=a-1) that establishes a [leave bank](/usc/5/6361.md?p=3) shall establish a [Leave Bank](/usc/5/6361.md?p=3) [Board](/usc/5/8401.md?p=5) consisting of 3 [members](/usc/5/8401.md?p=20), at least one of whom shall represent a [labor organization](/usc/5/7103.md?p=a-4) or [employee](/usc/5/6301.md?p=2) group, to administer the [leave bank](/usc/5/6361.md?p=3) under the provisions of this subchapter, in consultation with the [Office](/usc/5/5402.md?p=3) of Personnel Management.
  - (2) An [agency](/usc/5/3132.md?p=a-1) may establish more than 1 [Leave Bank](/usc/5/6361.md?p=3) [Board](/usc/5/8401.md?p=5) based upon the administrative units within the [agency](/usc/5/3132.md?p=a-1). No more than 1 [board](/usc/5/8401.md?p=5) may be established for each [leave bank](/usc/5/6361.md?p=3).
- (b) Each such [Board](/usc/5/8401.md?p=5) shall—
  - (1) review and approve applications to the [leave bank](/usc/5/6361.md?p=3) under [section 6367](/usc/5/6367.md);
  - (2) monitor each case of a [leave recipient](/usc/5/6361.md?p=5);
  - (3) monitor the amount of leave in the [leave bank](/usc/5/6361.md?p=3) and the number of applications for use of leave from the bank; and
  - (4) maintain an adequate amount of leave in the [leave bank](/usc/5/6361.md?p=3) to the greatest extent practicable.
