# §5757. Payment of expenses to obtain professional credentials

- (a) An [agency](/usc/5/5701.md?p=1) may use appropriated [funds](/usc/5/8401.md?p=6) or [funds](/usc/5/8401.md?p=6) otherwise available to the [agency](/usc/5/5701.md?p=1) to [pay](/usc/5/7511.md?p=a-4) for—
  - (1) expenses for [employees](/usc/5/5701.md?p=2) to obtain professional credentials, including expenses for professional accreditation, [State](/usc/5/8521.md?p=a-3)-imposed and professional licenses, and professional certification; and
  - (2) examinations to obtain such credentials.
- (b) The [authority](/usc/5/7103.md?p=a-6) under [subsection (a)](#a) may not be exercised on behalf of any [employee](/usc/5/5701.md?p=2) occupying or seeking to qualify for appointment to any [position](/usc/5/5102.md?p=a-3) that is excepted from the competitive [service](/usc/5/8401.md?p=26) because of the confidential, policy-determining, policy-making, or policy-advocating character of the [position](/usc/5/5102.md?p=a-3).
