# §5756. Home marketing incentive payment

- (a) Under regulations prescribed under [subsection (b)](#b), an [agency](/usc/5/5701.md?p=1) may [pay](/usc/5/7511.md?p=a-4) to an [employee](/usc/5/5701.md?p=2) who transfers in the interest of the [Government](/usc/5/5701.md?p=5) an amount to encourage the [employee](/usc/5/5701.md?p=2) to aggressively market the [employee](/usc/5/5701.md?p=2)’s residence at the official station from which transferred when—
  - (1) the residence is entered into a relocation [services](/usc/5/8401.md?p=26) program established under a contract in accordance with [section 5724c of this title](/usc/5/5724c.md) to arrange for the purchase of the residence;
  - (2) the [employee](/usc/5/5701.md?p=2) finds a buyer who completes the purchase of the residence through the program; and
  - (3) the sale of the residence results in a reduced cost to the [Government](/usc/5/5701.md?p=5).
- (b)
  - (1) The [Administrator](/usc/5/9801.md?p=2) of General [Services](/usc/5/8401.md?p=26) shall prescribe regulations to carry out this section.
  - (2) The regulations shall include a limitation on the maximum amount payable with respect to an [employee](/usc/5/5701.md?p=2)’s residence. The [Administrator](/usc/5/9801.md?p=2) shall establish the limitation in consultation with the [Director](/usc/5/8401.md?p=8) of the [Office](/usc/5/5402.md?p=3) of Management and Budget. For fiscal years 1997 and 1998, the maximum amount shall be the amount equal to five percent of the sale price of the residence.
