# §5405. Regulations


The [Office](/usc/5/5402.md?p=3) shall issue such regulations as it determines to be necessary for the [administration](/usc/5/9801.md?p=1) of this chapter, including the [administration](/usc/5/9801.md?p=1) of the [Fund](/usc/5/8401.md?p=6). The [Office](/usc/5/5402.md?p=3)’s regulations shall include criteria governing—

- (1) an [agency](/usc/5/3132.md?p=a-1) plan under [section 5406](/usc/5/5406.md);
- (2) the allocation of monies from the [Fund](/usc/5/8401.md?p=6) to [agencies](/usc/5/3132.md?p=a-1);
- (3) the nature, extent, duration, and adjustment of, and approval processes for, payments to individual [employees](/usc/5/4701.md?p=a-2) under this chapter;
- (4) the relationship to this chapter of [agency](/usc/5/3132.md?p=a-1) performance management [systems](/usc/5/8401.md?p=29);
- (5) [training](/usc/5/4101.md?p=4) of [supervisors](/usc/5/7103.md?p=a-10), managers, and other individuals involved in the process of making performance distinctions; and
- (6) the circumstances under which [funds](/usc/5/8401.md?p=6) may be allocated by the [Office](/usc/5/5402.md?p=3) to an [agency](/usc/5/3132.md?p=a-1) in amounts below or in excess of the [agency](/usc/5/3132.md?p=a-1)’s pro rata share.
