# §3598. Federal Bureau of Investigation Reserve Service

- (a) **Establishment.—** The [Director](/usc/5/8401.md?p=8) of the Federal Bureau of Investigation may provide for the establishment and [training](/usc/5/4101.md?p=4) of a Federal Bureau of Investigation Reserve [Service](/usc/5/8401.md?p=26) (hereinafter in this section referred to as the “FBI Reserve [Service](/usc/5/8401.md?p=26)”) for temporary reemployment of [employees](/usc/5/4701.md?p=a-2) in the Bureau during periods of emergency, as determined by the [Director](/usc/5/8401.md?p=8).
- (b) **Membership.—** Membership in the FBI Reserve [Service](/usc/5/8401.md?p=26) shall be limited to individuals who previously served as full-time [employees](/usc/5/4701.md?p=a-2) of the Bureau.
- (c) **Annuitants.—** If an [annuitant](/usc/5/8401.md?p=2) receiving an annuity from the [Civil Service Retirement and Disability Fund](/usc/5/8401.md?p=6) becomes temporarily reemployed pursuant to this section, such annuity shall not be discontinued thereby. An [annuitant](/usc/5/8401.md?p=2) so reemployed shall not be considered an [employee](/usc/5/4701.md?p=a-2) for the purposes of chapter [83](/usc/5/chptIII/sptG/ch83.md) or 84.
- (d) **No Impact on Bureau Personnel Ceiling.—** FBI Reserve [Service](/usc/5/8401.md?p=26) [members](/usc/5/8401.md?p=20) reemployed on a temporary basis pursuant to this section shall not count against any personnel ceiling applicable to the Bureau.
- (e) **Expenses.—** The [Director](/usc/5/8401.md?p=8) may provide [members](/usc/5/8401.md?p=20) of the FBI Reserve [Service](/usc/5/8401.md?p=26) transportation and per diem in lieu of subsistence, in accordance with applicable provisions of this title, for the purpose of participating in any [training](/usc/5/4101.md?p=4) that relates to [service](/usc/5/8401.md?p=26) as a [member](/usc/5/8401.md?p=20) of the FBI Reserve [Service](/usc/5/8401.md?p=26).
- (f) **Limitation on Membership.—** Membership of the FBI Reserve [Service](/usc/5/8401.md?p=26) is not to exceed 500 [members](/usc/5/8401.md?p=20) at any given time.
