# §3597. Reemployment following limited appointment in the Foreign Service


An [employee](/usc/5/4701.md?p=a-2) of any [agency](/usc/5/3132.md?p=a-1) who accepts, with the consent of the head of that [agency](/usc/5/3132.md?p=a-1), a limited appointment in the Foreign [Service](/usc/5/8401.md?p=26) under section 309 of the Foreign Service Act of 1980 is entitled, upon the expiration of that appointment, to be reemployed in that [employee](/usc/5/4701.md?p=a-2)’s former [position](/usc/5/5102.md?p=a-3) or in a corresponding or higher [position](/usc/5/5102.md?p=a-3) in that [agency](/usc/5/3132.md?p=a-1). Upon reemployment under this section, an [employee](/usc/5/4701.md?p=a-2) shall be entitled to any within-[grade](/usc/5/5102.md?p=a-5) increases in [pay](/usc/5/7511.md?p=a-4) which the [employee](/usc/5/4701.md?p=a-2) would have received if the [employee](/usc/5/4701.md?p=a-2) had remained in the former [position](/usc/5/5102.md?p=a-3) in the [agency](/usc/5/3132.md?p=a-1).
