# §3362. Promotion; effect of incentive award


An [agency](/usc/5/3132.md?p=a-1), in qualifying and selecting an [employee](/usc/5/4701.md?p=a-2) for promotion, shall give due weight to an incentive award under [chapter 45](/usc/5/chptIII/sptC/ch45.md) of this title. For the purpose of this section, “[agency](/usc/5/3132.md?p=a-1)” and “[employee](/usc/5/4701.md?p=a-2)” have the meanings given them by [section 4501 of this title](/usc/5/4501.md).
