# §3330. Government-wide list of vacant positions

- (a) For the purpose of this section, the term “[agency](/usc/5/3132.md?p=a-1)” means an [Executive agency](/usc/5/6501.md?p=2), excluding the [Government](/usc/5/4101.md?p=3) Accountability [Office](/usc/5/5402.md?p=3) and any [agency](/usc/5/3132.md?p=a-1) (or unit thereof) whose principal function is the conduct of foreign intelligence or counterintelligence activities, as determined by the President.
- (b) The [Office](/usc/5/5402.md?p=3) of Personnel Management shall establish and keep current a comprehensive list of all announcements of vacant [positions](/usc/5/5102.md?p=a-3) in the competitive [service](/usc/5/8401.md?p=26) within each [agency](/usc/5/3132.md?p=a-1) that are to be filled by appointment for more than one year and for which applications are being (or will soon be) accepted from outside the [agency](/usc/5/3132.md?p=a-1)’s work force.
- (c) Included for any [position](/usc/5/5102.md?p=a-3) listed shall be—
  - (1) a brief description of the [position](/usc/5/5102.md?p=a-3), including its title, tenure, location, and rate of [pay](/usc/5/7511.md?p=a-4);
  - (2) application procedures, including the period within which applications may be submitted and procedures for obtaining additional information; and
  - (3) any other information which the [Office](/usc/5/5402.md?p=3) considers appropriate.
- (d) The list shall be available to [members](/usc/5/8401.md?p=20) of the public.
- (e) The [Office](/usc/5/5402.md?p=3) shall prescribe such regulations as may be necessary to carry out this section. Any requirement under this section that [agencies](/usc/5/3132.md?p=a-1) notify the [Office](/usc/5/5402.md?p=3) as to the availability of any vacant [positions](/usc/5/5102.md?p=a-3) shall be designed so as to avoid any duplication of information otherwise required to be furnished under [section 3327 of this title](/usc/5/3327.md) or any other provision of law.
- (f) The [Office](/usc/5/5402.md?p=3) may, to the extent it determines appropriate, charge such fees to [agencies](/usc/5/3132.md?p=a-1) for [services](/usc/5/8401.md?p=26) provided under this section and for related Federal employment information. The [Office](/usc/5/5402.md?p=3) shall retain such fees to [pay](/usc/5/7511.md?p=a-4) the costs of providing such [services](/usc/5/8401.md?p=26) and information.
