# §315. Advisory Committee on Data for Evidence Building

- (a) **Establishment.—** The [Director](/usc/5/311.md?p=2), or the head of an [agency](/usc/5/311.md?p=1) designated by the [Director](/usc/5/311.md?p=2), shall establish an [Advisory Committee](/usc/5/1001.md?p=2-A) on Data for [Evidence](/usc/5/311.md?p=4) Building (in this section referred to as the “[Advisory Committee](/usc/5/1001.md?p=2-A)”) to review, analyze, and make recommendations on how to promote the use of Federal data for [evidence](/usc/5/311.md?p=4) building.
- (b) **Membership.—** The [members](/usc/5/5531.md?p=1) of the [Advisory Committee](/usc/5/1001.md?p=2-A) shall consist of the Chief Statistician of the United States, who shall serve as the Chair of the [Advisory Committee](/usc/5/1001.md?p=2-A), and other [members](/usc/5/5531.md?p=1) appointed by the [Director](/usc/5/311.md?p=2) as follows:
  - (1) One [member](/usc/5/5531.md?p=1) who is an [agency](/usc/5/311.md?p=1) Chief Information Officer.
  - (2) One [member](/usc/5/5531.md?p=1) who is an [agency](/usc/5/311.md?p=1) Chief Privacy Officer.
  - (3) One [member](/usc/5/5531.md?p=1) who is an [agency](/usc/5/311.md?p=1) Chief Performance Officer.
  - (4) Three [members](/usc/5/5531.md?p=1) who are [agency](/usc/5/311.md?p=1) Chief Data Officers.
  - (5) Three [members](/usc/5/5531.md?p=1) who are [agency](/usc/5/311.md?p=1) [Evaluation](/usc/5/311.md?p=3) Officers.
  - (6) Three [members](/usc/5/5531.md?p=1) who are [members](/usc/5/5531.md?p=1) of the Interagency Council for Statistical Policy[^1] established under [section 3504(e)(8) of title 44](/usc/44/3504.md?p=e-8).
  - (7) At least 10 [members](/usc/5/5531.md?p=1) who are representatives of [State](/usc/5/311.md?p=5) and local governments and nongovernmental stakeholders with expertise in government data policy, privacy, technology, transparency policy, [evaluation](/usc/5/311.md?p=3) and research methodologies, and other relevant subjects, of whom—
    - (A) at least one shall have expertise in transparency policy;
    - (B) at least one shall have expertise in privacy policy;
    - (C) at least one shall have expertise in statistical data use;
    - (D) at least one shall have expertise in information management;
    - (E) at least one shall have expertise in information technology; and
    - (F) at least one shall be from the research and [evaluation](/usc/5/311.md?p=3) community.
- (c) **Term of Service.—**
  - (1) **In general.—** Each [member](/usc/5/5531.md?p=1) of the [Advisory Committee](/usc/5/1001.md?p=2-A) shall serve for a term of 2 years.
  - (2) **Vacancy.—** Any [member](/usc/5/5531.md?p=1) appointed to fill a vacancy occurring before the expiration of the term for which the [member](/usc/5/5531.md?p=1)’s predecessor was appointed shall be appointed only for the remainder of that term. A vacancy in the Commission shall be filled in the manner in which the original appointment was made.
- (d) **Compensation.—** [Members](/usc/5/5531.md?p=1) of the [Advisory Committee](/usc/5/1001.md?p=2-A) shall serve without compensation.
- (e) **Duties.—** The [Advisory Committee](/usc/5/1001.md?p=2-A) shall—
  - (1) assist the [Director](/usc/5/311.md?p=2) in carrying out the duties of the [Director](/usc/5/311.md?p=2) under part D of subchapter III of [chapter 35](/usc/44/chch35.md) of title 44;
  - (2) evaluate and provide recommendations to the [Director](/usc/5/311.md?p=2) on how to facilitate data sharing, enable data linkage, and develop privacy enhancing techniques; and
  - (3) review the coordination of data sharing or availability for [evidence](/usc/5/311.md?p=4) building across all [agencies](/usc/5/311.md?p=1).
- (f) **Reports.—** The [Advisory Committee](/usc/5/1001.md?p=2-A) shall submit to the [Director](/usc/5/311.md?p=2) and make publicly available an annual report on the activities and findings of the [Advisory Committee](/usc/5/1001.md?p=2-A).
- (g) **Termination.—** The [Advisory Committee](/usc/5/1001.md?p=2-A) shall terminate not later than two years after the date of the first meeting.
