# §2304. Prohibited personnel practices affecting the Transportation Security Administration

- (a) **In General.—** Notwithstanding any other provision of law, any individual holding or applying for a [position](/usc/5/5102.md?p=a-3) within the Transportation Security [Administration](/usc/5/9801.md?p=1) shall be covered by—
  - (1) the provisions of [section 2302(b)(1)](/usc/5/2302.md?p=b-1), (8), and (9);
  - (2) any provision of law implementing [section 2302(b)(1)](/usc/5/2302.md?p=b-1), (8), or (9) by providing any right or remedy available to an [employee](/usc/5/4701.md?p=a-2) or applicant for employment in the civil [service](/usc/5/8401.md?p=26); and
  - (3) any rule or regulation prescribed under any provision of law referred to in paragraph [(1)](#a-1) or [(2)](#a-2).
- (b) **Rule of Construction.—** Nothing in this section shall be construed to affect any rights, apart from those described in [subsection (a)](#a), to which an individual described in [subsection (a)](#a) might otherwise be entitled under law.
