# §10203. Basic pay

- (a) **In General.—** The annual rates of [basic pay](/usc/5/8401.md?p=4) of [members](/usc/5/8401.md?p=20) of the [United States Secret Service Uniformed Division](/usc/5/10201.md?p=3) shall be fixed in accordance with the following schedule of rates, except that the payable annual rate of [basic pay](/usc/5/8401.md?p=4) for [positions](/usc/5/5102.md?p=a-3) at the Lieutenant, Captain, and Inspector ranks is limited to 95 percent of the rate of [pay](/usc/5/7511.md?p=a-4) for level V of the Executive Schedule under subchapter II of chapter 53.

- (b) **Schedule Adjustment.—**
  - (1)
    - (A) Effective at the beginning of the first [pay](/usc/5/7511.md?p=a-4) period commencing on or after the first day of the month in which an adjustment in the rates of [basic pay](/usc/5/8401.md?p=4) under the General Schedule takes effect under [section 5303](/usc/5/5303.md) or other [authority](/usc/5/7103.md?p=a-6), the schedule of annual rates of [basic pay](/usc/5/8401.md?p=4) of [members](/usc/5/8401.md?p=20) (except the Deputy Chiefs, Assistant Chief and Chief) shall be adjusted by the [Secretary](/usc/5/9901.md?p=2) by a percentage amount corresponding to the percentage adjustment made in the rates of [pay](/usc/5/7511.md?p=a-4) under the General Schedule.
    - (B) The [Secretary](/usc/5/9901.md?p=2) may establish a methodology of schedule adjustment that—
      - (i) results in uniform fixed-dollar step increments within any given rank; and
      - (ii) preserves the established percentage differences among rates of different ranks at the same step [position](/usc/5/5102.md?p=a-3).
  - (2) Notwithstanding [paragraph (1)](#b-1), the payable annual rate of [basic pay](/usc/5/8401.md?p=4) for [positions](/usc/5/5102.md?p=a-3) at the Lieutenant, Captain, and Inspector ranks after adjustment under [paragraph (1)](#b-1) may not exceed 95 percent of the rate of [pay](/usc/5/7511.md?p=a-4) for level V of the Executive Schedule under subchapter II of chapter 53.
  - (3) Locality-based comparability payments authorized under [section 5304](/usc/5/5304.md) shall be applicable to the [basic pay](/usc/5/8401.md?p=4) for all ranks under this section, except locality-based comparability payments may not be paid at a rate which, when added to the rate of [basic pay](/usc/5/8401.md?p=4) otherwise payable to the [member](/usc/5/8401.md?p=20), would cause the total to exceed the rate of [basic pay](/usc/5/8401.md?p=4) payable for level IV of the Executive Schedule.
