# §10103. Career paths

- (a) **In General.—** The [Administrator](/usc/5/9801.md?p=2) shall—
  - (1) ensure that appropriate career paths for personnel of the [Agency](/usc/5/3132.md?p=a-1) are identified, including the education, [training](/usc/5/4101.md?p=4), experience, and assignments necessary for career progression within the [Agency](/usc/5/3132.md?p=a-1); and
  - (2) publish information on the career paths described in [paragraph (1)](#a-1).
- (b) **Education, Training, and Experience.—** The [Administrator](/usc/5/9801.md?p=2) shall ensure that all personnel of the [Agency](/usc/5/3132.md?p=a-1) are provided the opportunity to acquire the education, [training](/usc/5/4101.md?p=4), and experience necessary to qualify for promotion within the [Agency](/usc/5/3132.md?p=a-1), including, as appropriate, the opportunity to participate in the Rotation Program established under section 844 of the Homeland Security Act of 2002.
- (c) **Policy.—** The [Administrator](/usc/5/9801.md?p=2) shall establish a policy for assigning [Agency](/usc/5/3132.md?p=a-1) personnel to [positions](/usc/5/5102.md?p=a-3) that provides for a balance between—
  - (1) the need for such personnel to serve in career enhancing [positions](/usc/5/5102.md?p=a-3); and
  - (2) the need to require [service](/usc/5/8401.md?p=26) in a [position](/usc/5/5102.md?p=a-3) for a sufficient period of time to provide the stability necessary—
    - (A) to carry out the duties of that [position](/usc/5/5102.md?p=a-3); and
    - (B) for responsibility and accountability for actions taken in that [position](/usc/5/5102.md?p=a-3).
