# §763a. Specific criteria for INTELSAT


In securing the privatizations required by [section 763 of this title](/usc/47/763.md), the following additional criteria with respect to [INTELSAT](/usc/47/769.md?p=a-1) privatization shall be applied as licensing criteria for purposes of part A:

- (1) **[^1] Technical coordination under intelsat agreements.—** Technical coordination shall not be used to impair competition or competitors, and shall be conducted under [International Telecommunication Union](/usc/47/769.md?p=a-6) procedures and not under Article XIV(d) of the [INTELSAT Agreement](/usc/47/769.md?p=a-13).

# §763c. Space segment capacity of the GMDSS


The [United States](/usc/47/38.md) shall preserve the [space segment](/usc/47/769.md?p=a-10) capacity of the [GMDSS](/usc/47/769.md?p=a-20). This section is not intended to alter the status that the [GMDSS](/usc/47/769.md?p=a-20) would otherwise have under [United States](/usc/47/38.md) laws and regulations of the [International Telecommunication Union](/usc/47/769.md?p=a-6) with respect to spectrum, [orbital locations](/usc/47/769.md?p=a-9), or other operational parameters, or to be a barrier to competition for the provision of [GMDSS](/usc/47/769.md?p=a-20) services.
