# §761a. Incentives; limitation on expansion pending privatization

- (a) **Limitation—** Until [INTELSAT](/usc/47/769.md?p=a-1), [Inmarsat](/usc/47/769.md?p=a-2), and their successor or separate entities are privatized in accordance with the requirements of this subchapter, [INTELSAT](/usc/47/769.md?p=a-1), [Inmarsat](/usc/47/769.md?p=a-2), and their successor or separate entities, respectively, shall not be permitted to provide [additional services](/usc/47/769.md?p=a-12). The [Commission](/usc/47/702.md?p=10) shall take all necessary measures to implement this requirement, including denial by the [Commission](/usc/47/702.md?p=10) of licensing for such services.
- (b) **Orbital location incentives—** Until such privatization is achieved, the United States shall oppose and decline to facilitate applications by such entities for new [orbital locations](/usc/47/769.md?p=a-9) to provide such services.
