# §6104. Commercial fishing industry vessel casualty statistics

- (a) The [Secretary](/usc/46/2101.md?p=46) shall compile statistics concerning marine casualties from data compiled from insurers of [fishing vessels](/usc/46/10101.md?p=4), [fish processing vessels](/usc/46/2101.md?p=13), and [fish tender vessels](/usc/46/2101.md?p=14).
- (b) A [person](/usc/46/3701.md?p=3) underwriting primary insurance for a [fishing vessel](/usc/46/10101.md?p=4), [fish processing vessel](/usc/46/2101.md?p=13), or [fish tender vessel](/usc/46/2101.md?p=14) shall submit periodically to the [Secretary](/usc/46/2101.md?p=46) data concerning marine casualties that is required by regulations prescribed by the [Secretary](/usc/46/2101.md?p=46).
- (c) After consulting with the insurance industry, the [Secretary](/usc/46/2101.md?p=46) shall prescribe regulations under this section to gather a statistical base for analyzing vessel risks.
- (d) The [Secretary](/usc/46/2101.md?p=46) may delegate to a qualified [person](/usc/46/3701.md?p=3) that has knowledge and experience in the collection of statistical insurance data the authority of the [Secretary](/usc/46/2101.md?p=46) under this section to compile statistics from insurers.
