# §55335. Revocations and terminations of designations

- (a) **Revocations.—** After notice and an opportunity for a hearing, the [Secretary](/usc/46/53101.md?p=8) of Transportation may revoke a designation of a [vessel](/usc/46/53501.md?p=9) as an [American Great Lakes vessel](/usc/46/55331.md?p=1) if the [Secretary](/usc/46/53101.md?p=8) finds that—
  - (1) the [vessel](/usc/46/53501.md?p=9) does not meet a requirement for the designation;
  - (2) the [vessel](/usc/46/53501.md?p=9) has been operated in violation of this subchapter; or
  - (3) the owner or operator of the [vessel](/usc/46/53501.md?p=9) has violated an [agreement](/usc/46/53201.md?p=8) made under [section 55332(b) of this title](/usc/46/55332.md?p=b).
- (b) **Terminations.—** On petition and a showing of good cause by the owner of a [vessel](/usc/46/53501.md?p=9), the [Secretary](/usc/46/53101.md?p=8) may terminate the designation of a [vessel](/usc/46/53501.md?p=9) as an [American Great Lakes vessel](/usc/46/55331.md?p=1). The [Secretary](/usc/46/53101.md?p=8) may impose conditions in a termination order to prevent significant adverse effects on other operators of [vessels](/usc/46/53501.md?p=9) of the [United States](/usc/46/53101.md?p=10).

In subsection (a)(3), the words “construction and purchase” before “agreement” are omitted because the source provision for section 55332(b) of the revised title does not say anything about construction.

In subsection (b), the words “vessels of the United States” are substituted for “United States-flag vessel” for consistency in the revised title.
