# §3564. Effect on other laws

- (a) **Title 44, United States Code.—** This subchapter does not diminish the authority under [section 3510](/usc/44/3510.md) of the [Director](/usc/44/3502.md?p=4) to direct, and of an [agency](/usc/44/3502.md?p=1) to make, disclosures that are not inconsistent with any applicable law.
- (b) **Title 13 and Title 44, United States Code.—** This subchapter does not diminish the authority of the Bureau of the Census to provide information in accordance with sections [8](/usc/13/8.md), [16](/usc/13/16.md), [301](/usc/13/301.md), and [401](/usc/13/401.md) of title 13 and [section 2108 of this title](/usc/44/2108.md).
- (c) **Title 13, United States Code.—** This subchapter shall not be construed as authorizing the disclosure for [nonstatistical purposes](/usc/44/3561.md?p=8) of demographic [data](/usc/44/3502.md?p=16) or information collected by the Bureau of the Census pursuant to [section 9 of title 13](/usc/13/9.md).
- (d) **Various Energy Statutes.—** [Data](/usc/44/3502.md?p=16) or information acquired by the Energy Information Administration under a pledge of confidentiality and designated by the Energy Information Administration to be used for exclusively [statistical purposes](/usc/44/3561.md?p=12) shall not be disclosed in [identifiable form](/usc/44/3561.md?p=7) for [nonstatistical purposes](/usc/44/3561.md?p=8) under—
  - (1) section 12, 20, or 59 of the Federal Energy Administration Act of 1974 ([15 U.S.C. 771](/usc/15/771.md), 779, 790h);
  - (2) section 11 of the Energy Supply and Environmental Coordination Act of 1974 ([15 U.S.C. 796](/usc/15/796.md)); or
  - (3) section 205 or 407 of the Department of Energy Organization Act ([42 U.S.C. 7135](/usc/42/7135.md), 7177).
- (e) **Section 201 of Congressional Budget Act of 1974.—** This subchapter shall not be construed to limit any authorities of the Congressional Budget Office to work (consistent with laws governing the confidentiality of information the disclosure of which would be a violation of law) with databases of Designated Statistical [Agencies](/usc/44/3502.md?p=1) (as defined in [section 3576(e)](/usc/44/3576.md?p=e)), either separately or, for [data](/usc/44/3502.md?p=16) that may be shared pursuant to [section 3576(c)](/usc/44/3576.md?p=c) or other authority, jointly in order to improve the general utility of these databases for the [statistical purpose](/usc/44/3561.md?p=12) of analyzing pension and health care financing issues.
- (f) **Preemption of State Law.—** Nothing in this subchapter shall preempt applicable State law regarding the confidentiality of [data](/usc/44/3502.md?p=16) collected by the States.
- (g) **Statutes Regarding False Statements.—** Notwithstanding [section 3572](/usc/44/3572.md), information collected by an [agency](/usc/44/3502.md?p=1) for exclusively [statistical purposes](/usc/44/3561.md?p=12) under a pledge of confidentiality may be provided by the collecting [agency](/usc/44/3502.md?p=1) to a law enforcement [agency](/usc/44/3502.md?p=1) for the prosecution of submissions to the collecting [agency](/usc/44/3502.md?p=1) of false statistical information under statutes that authorize criminal [penalties](/usc/44/3502.md?p=14) (such as [section 221 of title 13](/usc/13/221.md)) or civil [penalties](/usc/44/3502.md?p=14) for the provision of false statistical information, unless such disclosure or use would otherwise be prohibited under Federal law.
- (h) **Construction.—** Nothing in this subchapter shall be construed as restricting or diminishing any confidentiality protections or [penalties](/usc/44/3502.md?p=14) for unauthorized disclosure that otherwise apply to [data](/usc/44/3502.md?p=16) or information collected for [statistical purposes](/usc/44/3561.md?p=12) or [nonstatistical purposes](/usc/44/3561.md?p=8), including, but not limited to, section 6103 of the Internal Revenue Code of 1986.
- (i) **Authority of Congress.—** Nothing in this subchapter shall be construed to affect the authority of the Congress, including its committees, members, or [agents](/usc/44/3561.md?p=2), to obtain [data](/usc/44/3502.md?p=16) or information for a [statistical purpose](/usc/44/3561.md?p=12), including for oversight of an [agency](/usc/44/3502.md?p=1)’s [statistical activities](/usc/44/3561.md?p=10).
