# §9116. Diligence requirements

- (a) **Rules and regulations—** The [Administrator](/usc/42/9102.md?p=2) shall promulgate regulations requiring each [licensee](/usc/42/9102.md?p=10) to pursue diligently the [construction](/usc/42/9102.md?p=6) and operation of the [ocean thermal energy conversion facility](/usc/42/9102.md?p=11) or [plantship](/usc/42/9102.md?p=13) to which the license applies.
- (b) **Termination of license—** If the [Administrator](/usc/42/9102.md?p=2) determines that a [licensee](/usc/42/9102.md?p=10) is not pursuing diligently the [construction](/usc/42/9102.md?p=6) and operation of the [ocean thermal energy conversion facility](/usc/42/9102.md?p=11) or [plantship](/usc/42/9102.md?p=13) to which the license applies, or that the [project](/usc/42/13641.md?p=2) has apparently been abandoned, the [Administrator](/usc/42/9102.md?p=2) shall cause proceedings to be instituted under [section 9121 of this title](/usc/42/9121.md) to terminate the license.
