# §6372g. Allocation of grants

- (a) Grants made under this part shall be allocated among the [States](/usc/42/6202.md?p=4) in accordance with a formula to be prescribed, by rule, by the [Secretary](/usc/42/6202.md?p=1), taking into account population and climate of each [State](/usc/42/6202.md?p=4), and such other factors as the [Secretary](/usc/42/6202.md?p=1) may deem appropriate.
- (b) The total amount allocated to any [State](/usc/42/6202.md?p=4) under [subsection (a)](#a) in any year shall not exceed 10 percent of the total amount allocated to all the [States](/usc/42/6202.md?p=4) in such year under such [subsection (a)](#a). Except for the District of Columbia, Puerto Rico, Guam, American Samoa, and the Virgin Islands, not less than 0.5 percent of such total [allocation](/usc/42/2021b.md?p=2) to all [States](/usc/42/6202.md?p=4) for that year shall be allocated in such year for the total of grants in each [State](/usc/42/6202.md?p=4) which has an approved [State](/usc/42/6202.md?p=4) plan under this part.
