# §605. Administrative provisions

- (a) **Quarterly—** The [Secretary](/usc/42/1301.md?p=a-6) shall pay each [grant](/usc/42/1397j.md?p=10) payable to a [State](/usc/42/619.md?p=5) under [section 603 of this title](/usc/42/603.md) in quarterly installments, subject to this section.
- (b) **Notification—** Not later than 3 months before the payment of any such quarterly installment to a [State](/usc/42/619.md?p=5), the [Secretary](/usc/42/1301.md?p=a-6) shall notify the [State](/usc/42/619.md?p=5) of the amount of any reduction determined under [section 612(a)(1)(B) of this title](/usc/42/612.md?p=a-1-B) with respect to the [State](/usc/42/619.md?p=5).
- (c) **Computation and certification of payments to States—**
  - (1) **Computation—** The [Secretary](/usc/42/1301.md?p=a-6) shall estimate the amount to be paid to each eligible [State](/usc/42/619.md?p=5) for each quarter under this part, such estimate to be based on a report filed by the [State](/usc/42/619.md?p=5) containing an estimate by the [State](/usc/42/619.md?p=5) of the total sum to be expended by the [State](/usc/42/619.md?p=5) in the quarter under the [State](/usc/42/619.md?p=5) program funded under this part and such other information as the [Secretary](/usc/42/1301.md?p=a-6) may find necessary.
  - (2) **Certification—** The [Secretary](/usc/42/1301.md?p=a-6) of Health and Human Services shall certify to the [Secretary](/usc/42/1301.md?p=a-6) of the Treasury the amount estimated under [paragraph (1)](#c-1) with respect to a [State](/usc/42/619.md?p=5), reduced or increased to the extent of any overpayment or underpayment which the [Secretary](/usc/42/1301.md?p=a-6) of Health and Human Services determines was made under this part to the [State](/usc/42/619.md?p=5) for any prior quarter and with respect to which adjustment has not been made under this paragraph.
- (d) **Payment method—** Upon receipt of a certification under [subsection (c)(2)](#c-2) with respect to a [State](/usc/42/619.md?p=5), the [Secretary](/usc/42/1301.md?p=a-6) of the Treasury shall, through the Fiscal Service of the Department of the Treasury and before audit or settlement by the Government Accountability Office, pay to the [State](/usc/42/619.md?p=5), at the time or times fixed by the [Secretary](/usc/42/1301.md?p=a-6) of Health and Human Services, the amount so certified.

### Effective Date of 1997 Amendment

Amendment by Pub. L. 105–33 effective as if included in the provision of Pub. L. 104–193 amended at the time the provision became law, see section 5518(d) of Pub. L. 105–33, set out as a note under section 862a of Title 21, Food and Drugs.

### Effective Date

Section effective July 1, 1997, with transition rules relating to State options to accelerate such date, rules relating to claims, actions, and proceedings commenced before such date, rules relating to closing out of accounts for terminated or substantially modified programs and continuance in office of Assistant Secretary for Family Support, and provisions relating to termination of entitlement under AFDC program, see section 116 of Pub. L. 104–193, as amended, set out as a note under section 601 of this title.
