# §4370m–3. Interstate compacts

- (a) **In general—** The consent of Congress is given for 3 or more contiguous [States](/usc/42/2021b.md?p=14) to enter into an interstate [compact](/usc/42/2021b.md?p=4) establishing regional infrastructure development [agencies](/usc/42/4370m.md?p=1) to facilitate [authorization](/usc/42/4370m.md?p=3) and review of [covered projects](/usc/42/4370m.md?p=6-A), under [State](/usc/42/2021b.md?p=14) law or in the exercise of delegated permitting authority described under [section 4370m–5 of this title](/usc/42/4370m–5.md), that will advance infrastructure development, production, and generation within the [States](/usc/42/2021b.md?p=14) that are parties to the [compact](/usc/42/2021b.md?p=4).
- (b) **Regional infrastructure—** For the purpose of this subchapter, a regional infrastructure development [agency](/usc/42/4370m.md?p=1) referred to in [subsection (a)](#a) shall have the same authorities and responsibilities of a [State agency](/usc/42/300s–3.md?p=12).
