# §4336c. Adoption of categorical exclusions


An [agency](/usc/42/8262.md?p=1) may adopt a [categorical exclusion](/usc/42/4336e.md?p=1) listed in another [agency](/usc/42/8262.md?p=1)’s NEPA procedures for a category of proposed [agency](/usc/42/8262.md?p=1) actions for which the [categorical exclusion](/usc/42/4336e.md?p=1) was established consistent with this paragraph. The [agency](/usc/42/8262.md?p=1) shall—

- (1) identify the [categorical exclusion](/usc/42/4336e.md?p=1) listed in another [agency](/usc/42/8262.md?p=1)’s NEPA procedures that covers a category of proposed actions or related actions;
- (2) consult with the [agency](/usc/42/8262.md?p=1) that established the [categorical exclusion](/usc/42/4336e.md?p=1) to ensure that the proposed adoption of the [categorical exclusion](/usc/42/4336e.md?p=1) to a category of actions is appropriate;
- (3) identify to the public the [categorical exclusion](/usc/42/4336e.md?p=1) that the [agency](/usc/42/8262.md?p=1) plans to use for its proposed actions; and
- (4) document adoption of the [categorical exclusion](/usc/42/4336e.md?p=1).
