# §3150. Changed project circumstances


In any case in which a [grant](/usc/42/3122.md?p=8) (including a supplementary [grant](/usc/42/3122.md?p=8) described in [section 3145 of this title](/usc/42/3145.md)) has been made by the [Secretary](/usc/42/3122.md?p=13) under this subchapter (or made under this chapter, as in effect on the day before the effective date of the Economic Development Administration Reform Act of 1998) for a [project](/usc/42/13641.md?p=2), and, after the [grant](/usc/42/3122.md?p=8) has been made but before completion of the [project](/usc/42/13641.md?p=2), the purpose or scope of the [project](/usc/42/13641.md?p=2) that was the basis of the [grant](/usc/42/3122.md?p=8) is modified, the [Secretary](/usc/42/3122.md?p=13) may approve, subject (except for a [grant](/usc/42/3122.md?p=8) for which funds were obligated in fiscal year 1995) to the availability of appropriations, the use of [grant](/usc/42/3122.md?p=8) funds for the modified [project](/usc/42/13641.md?p=2) if the [Secretary](/usc/42/3122.md?p=13) determines that—

- (1) the modified [project](/usc/42/13641.md?p=2) meets the requirements of this subchapter and is consistent with the [comprehensive economic development strategy](/usc/42/3122.md?p=3) submitted as part of the application for the [grant](/usc/42/3122.md?p=8); and
- (2) the modifications are necessary to enhance economic development in the area for which the [project](/usc/42/13641.md?p=2) is being carried out.
