# §3058j. State legal assistance development


A [State agency](/usc/42/3002.md?p=52) shall provide the services of an individual who shall be known as a [State](/usc/42/3002.md?p=51) [legal assistance](/usc/42/3002.md?p=33) developer, and the services of other personnel, sufficient to ensure—

- (1) [State](/usc/42/3002.md?p=51) leadership in securing and maintaining the legal rights of [older individuals](/usc/42/3002.md?p=40);
- (2) [State](/usc/42/3002.md?p=51) capacity for coordinating the provision of [legal assistance](/usc/42/3002.md?p=33);
- (3) [State](/usc/42/3002.md?p=51) capacity to provide technical assistance, training, and other supportive functions to area [agencies](/usc/42/8262.md?p=1) on aging, [legal assistance](/usc/42/3002.md?p=33) providers, ombudsmen, and other persons, as appropriate;
- (4) [State](/usc/42/3002.md?p=51) capacity to promote financial management services to [older individuals](/usc/42/3002.md?p=40) at risk of conservatorship;
- (5) [State](/usc/42/3002.md?p=51) capacity to assist [older individuals](/usc/42/3002.md?p=40) in understanding their rights, exercising choices, benefiting from services and opportunities authorized by law, and maintaining the rights of [older individuals](/usc/42/3002.md?p=40) at risk of guardianship; and
- (6) [State](/usc/42/3002.md?p=51) capacity to improve the quality and quantity of legal services provided to [older individuals](/usc/42/3002.md?p=40).
