# §3057k–21. Program

- (a) **In general—** The [Assistant Secretary](/usc/42/3002.md?p=7) may carry out a competitive demonstration [program](/usc/42/3056p.md?p=a-7) for making grants to [tribal organizations](/usc/42/3002.md?p=56) or organizations serving Native Hawaiians with applications approved under parts A and B, to pay for the Federal share of carrying out [programs](/usc/42/3056p.md?p=a-7), to enable the organizations described in this subsection to build their capacity to provide a wider range of in-home and community [supportive services](/usc/42/3056p.md?p=a-8) to enable [older individuals](/usc/42/3002.md?p=40) to maintain their health and [independence](/usc/42/242q–4.md?p=1-B) and to avoid [long-term care facility](/usc/42/3002.md?p=35) placement.
- (b) **Supportive services—**
  - (1) **In general—** Subject to [paragraph (2)](#b-2), [supportive services](/usc/42/3056p.md?p=a-8) described in [subsection (a)](#a) may include any of the activities described in [section 3030d(a) of this title](/usc/42/3030d.md?p=a).
  - (2) **Priority—** The [Assistant Secretary](/usc/42/3002.md?p=7), in making grants under this section, shall give priority to organizations that will use the grant funds for [supportive services](/usc/42/3056p.md?p=a-8) described in [subsection (a)](#a) that are for in-home assistance, transportation, [information and referral](/usc/42/3002.md?p=29), case management, health and wellness [programs](/usc/42/3056p.md?p=a-7), legal services, family [caregiver](/usc/42/3002.md?p=18-B) support services, and other services that directly support the [independence](/usc/42/242q–4.md?p=1-B) of the [older individuals](/usc/42/3002.md?p=40) served.
  - (3) **Rule of construction—** Nothing in this section shall be construed or interpreted to prohibit the provision of [supportive services](/usc/42/3056p.md?p=a-8) under part A or B.
