# §300z–4. Grants for demonstration projects for services

- (a) **Priorities—** In approving applications for grants for demonstration [projects](/usc/42/13641.md?p=2) for [services](/usc/42/201.md?p=a) under this subchapter, the [Secretary](/usc/42/201.md?p=c) shall give priority to applicants who—
  - (1) serve an area where there is a high incidence of [adolescent](/usc/42/300z–1.md?p=a-9) pregnancy;
  - (2) serve an area with a high proportion of low-income families and where the availability of [programs](/usc/42/274l–1.md?p=4) of care for pregnant [adolescents](/usc/42/300z–1.md?p=a-9) and [adolescent](/usc/42/300z–1.md?p=a-9) parents is low;
  - (3) show evidence—
    - (A) in the case of an applicant who will provide [care services](/usc/42/300z–1.md?p=a-7), of having the ability to bring together a wide range of needed [core services](/usc/42/300z–1.md?p=a-5) and, as appropriate, [supplemental services](/usc/42/300z–1.md?p=a-6) in comprehensive single-site [projects](/usc/42/13641.md?p=2), or to establish a well-integrated network of such [services](/usc/42/201.md?p=a) (appropriate for the target population and geographic area to be served including the special needs of rural areas) for pregnant [adolescents](/usc/42/300z–1.md?p=a-9) or [adolescent](/usc/42/300z–1.md?p=a-9) parents; or
    - (B) in the case of an applicant who will provide [prevention services](/usc/42/300z–1.md?p=a-8), of having the ability to provide [prevention services](/usc/42/300z–1.md?p=a-8) for [adolescents](/usc/42/300z–1.md?p=a-9) and their families which are appropriate for the target population and the geographic area to be served, including the special needs of rural areas;
  - (4) will utilize to the maximum extent feasible existing available [programs](/usc/42/274l–1.md?p=4) and facilities such as neighborhood and primary health care centers, maternity homes which provide or can be equipped to provide [services](/usc/42/201.md?p=a) to pregnant [adolescents](/usc/42/300z–1.md?p=a-9), [agencies](/usc/42/8262.md?p=1) serving families, youth, and children with established [programs](/usc/42/274l–1.md?p=4) of [service](/usc/42/201.md?p=a) to pregnant [adolescents](/usc/42/300z–1.md?p=a-9) and vulnerable families, licensed adoption [agencies](/usc/42/8262.md?p=1), children and youth centers, maternal and infant health centers, regional rural health facilities, [school](/usc/42/300j–21.md?p=6) and other educational [programs](/usc/42/274l–1.md?p=4), mental health [programs](/usc/42/274l–1.md?p=4), nutrition [programs](/usc/42/274l–1.md?p=4), recreation [programs](/usc/42/274l–1.md?p=4), and other ongoing pregnancy [prevention services](/usc/42/300z–1.md?p=a-8) and [programs](/usc/42/274l–1.md?p=4) of care for pregnant [adolescents](/usc/42/300z–1.md?p=a-9) and [adolescent](/usc/42/300z–1.md?p=a-9) parents;
  - (5) make use, to the maximum extent feasible, of other Federal, [State](/usc/42/201.md?p=f), and local funds, [programs](/usc/42/274l–1.md?p=4), contributions, and other third-party reimbursements;
  - (6) can demonstrate a community commitment to the [program](/usc/42/274l–1.md?p=4) by making available to the demonstration [project](/usc/42/13641.md?p=2) non-Federal funds, personnel, and facilities;
  - (7) have involved the community to be served, including public and private [agencies](/usc/42/8262.md?p=1), [adolescents](/usc/42/300z–1.md?p=a-9), and families, in the planning and implementation of the demonstration [project](/usc/42/13641.md?p=2); and
  - (8) will demonstrate innovative and effective approaches in addressing the problems of [adolescent](/usc/42/300z–1.md?p=a-9) premarital sexual relations, pregnancy, or parenthood, including approaches to provide pregnant [adolescents](/usc/42/300z–1.md?p=a-9) with adequate information about adoption.
- (b) **Factors to be considered in making grants; special needs of rural areas—**
  - (1) The amount of a grant for a demonstration [project](/usc/42/13641.md?p=2) for [services](/usc/42/201.md?p=a) under this subchapter shall be determined by the [Secretary](/usc/42/201.md?p=c), based on factors such as the incidence of [adolescent](/usc/42/300z–1.md?p=a-9) pregnancy in the geographic area to be served, and the adequacy of pregnancy [prevention services](/usc/42/300z–1.md?p=a-8) and [programs](/usc/42/274l–1.md?p=4) of care for pregnant [adolescents](/usc/42/300z–1.md?p=a-9) and [adolescent](/usc/42/300z–1.md?p=a-9) parents in such area.
  - (2) In making grants for demonstration [projects](/usc/42/13641.md?p=2) for [services](/usc/42/201.md?p=a) under this subchapter, the [Secretary](/usc/42/201.md?p=c) shall consider the special needs of rural areas and, to the maximum extent practicable, shall distribute funds taking into consideration the relative number of [adolescents](/usc/42/300z–1.md?p=a-9) in such areas in need of such [services](/usc/42/201.md?p=a).
- (c) **Duration; Federal share—**
  - (1) A grantee may not receive funds for a demonstration [project](/usc/42/13641.md?p=2) for [services](/usc/42/201.md?p=a) under this subchapter for a period in excess of 5 years.
  - (2)
    - (A) Subject to [paragraph (3)](#c-3), a grant for a demonstration [project](/usc/42/13641.md?p=2) for [services](/usc/42/201.md?p=a) under this subchapter may not exceed—
      - (i) 70 per centum of the costs of the [project](/usc/42/13641.md?p=2) for the first and second years of the [project](/usc/42/13641.md?p=2);
      - (ii) 60 per centum of such costs for the third year of the [project](/usc/42/13641.md?p=2);
      - (iii) 50 per centum of such costs for the fourth year of the [project](/usc/42/13641.md?p=2); and
      - (iv) 40 per centum of such costs for the fifth year of the [project](/usc/42/13641.md?p=2).
    - (B) Non-Federal contributions required by [subparagraph (A)](#c-2-A) may be in cash or in kind, fairly evaluated, including plant, equipment, or [services](/usc/42/201.md?p=a).
  - (3) The [Secretary](/usc/42/201.md?p=c) may waive the limitation specified in [paragraph (2)(A)](#c-2-A) for any year in accordance with criteria established by regulation.
