# §300z–10. Restrictions

- (a) Grants or payments may be made only to [programs](/usc/42/274l–1.md?p=4) or [projects](/usc/42/13641.md?p=2) which do not provide abortions or abortion counseling or referral, or which do not subcontract with or make any payment to any person who provides abortions or abortion counseling or referral, except that any such [program](/usc/42/274l–1.md?p=4) or [project](/usc/42/13641.md?p=2) may provide referral for abortion counseling to a pregnant [adolescent](/usc/42/300z–1.md?p=a-9) if such [adolescent](/usc/42/300z–1.md?p=a-9) and the parents or guardians of such [adolescent](/usc/42/300z–1.md?p=a-9) request such referral; and grants may be made only to [projects](/usc/42/13641.md?p=2) or [programs](/usc/42/274l–1.md?p=4) which do not advocate, promote, or encourage abortion.
- (b) The [Secretary](/usc/42/201.md?p=c) shall ascertain whether [programs](/usc/42/274l–1.md?p=4) or [projects](/usc/42/13641.md?p=2) comply with [subsection (a)](#a) and take appropriate action if [programs](/usc/42/274l–1.md?p=4) or [projects](/usc/42/13641.md?p=2) do not comply with such subsection, including withholding of funds.
