# §300x–63. Continuation of certain programs

- (a) **In general—** Of the amount allotted to the [State](/usc/42/201.md?p=f) of Hawaii under [section 300x of this title](/usc/42/300x.md), and the amount allotted to such [State](/usc/42/201.md?p=f) under [section 300x–21 of this title](/usc/42/300x–21.md), an amount equal to the proportion of Native Hawaiians residing in the [State](/usc/42/201.md?p=f) to the total population of the [State](/usc/42/201.md?p=f) shall be available, respectively, for carrying out the [program involved](/usc/42/300x–64.md?p=a-1) for Native Hawaiians.
- (b) **Expenditure of amounts—** The amount made available under [subsection (a)](#a) may be expended only through contracts entered into by the [State](/usc/42/201.md?p=f) of Hawaii with public and private [nonprofit](/usc/42/300s–3.md?p=3) organizations to enable such organizations to plan, conduct, and administer comprehensive [substance use disorder](/usc/42/300x–34.md?p=4) and [treatment](/usc/42/11851.md?p=11) [programs](/usc/42/274l–1.md?p=4) for the benefit of Native Hawaiians. In entering into contracts under this section, the [State](/usc/42/201.md?p=f) of Hawaii shall give preference to Native Hawaiian organizations and Native Hawaiian health centers.
- (c) **Definitions—** For the purposes of this subsection,[^1] the terms “Native Hawaiian”, “Native Hawaiian organization”, and “Native Hawaiian health center” have the meaning given such terms in [section 11707 of this title](/usc/42/11707.md).
