# §300t–13. Grants to States for reduction of excess hospital capacity

- (a) **“Excess hospital capacity” defined; particular activities—** For the purpose of demonstrating the effectiveness of various means for reducing excesses in resources and facilities of [hospitals](/usc/42/300s–3.md?p=1) (referred to in this section as “excess [hospital](/usc/42/300s–3.md?p=1) capacity”), the [Secretary](/usc/42/201.md?p=c) may make grants to [State Agencies](/usc/42/300s–3.md?p=12) designated under [section 300m(b)(3)](/usc/42/300m.md)[^1] of this title to assist such [Agencies](/usc/42/8262.md?p=1) in—
  - (1) identifying (by geographic region or by health [service](/usc/42/201.md?p=a)) excess [hospital](/usc/42/300s–3.md?p=1) capacity,
  - (2) developing [programs](/usc/42/274l–1.md?p=4) to inform the public of the costs associated with excess [hospital](/usc/42/300s–3.md?p=1) capacity,
  - (3) developing [programs](/usc/42/274l–1.md?p=4) to reduce excess [hospital](/usc/42/300s–3.md?p=1) capacity in a manner which will produce the greatest savings in the cost of health care delivery,
  - (4) developing means to overcome barriers to the reduction of excess [hospital](/usc/42/300s–3.md?p=1) capacity,
  - (5) in planning, evaluating, and carrying out [programs](/usc/42/274l–1.md?p=4) to decertify health care facilities providing health [services](/usc/42/201.md?p=a) that are not appropriate, and
  - (6) any other activity related to the reduction of excess [hospital](/usc/42/300s–3.md?p=1) capacity.
- (b) **Terms and conditions—** Grants under [subsection (a)](#a) shall be made on such terms and conditions as the [Secretary](/usc/42/201.md?p=c) may prescribe.
