# §300j–25. Drinking water fountain replacement for schools

- (a) **Establishment—** Not later than 1 year after October 23, 2018, the [Administrator](/usc/42/4005.md?p=1) shall establish a grant [program](/usc/42/274l–1.md?p=4) to provide assistance to [local educational agencies](/usc/42/300j–21.md?p=3) for the [replacement](/usc/42/300j–21.md?p=5) of drinking water fountains manufactured prior to 1988.
- (b) **Use of funds—** Funds awarded under the grant [program](/usc/42/274l–1.md?p=4)—
  - (1) shall be used to pay the costs of [replacement](/usc/42/300j–21.md?p=5) of drinking water fountains in [schools](/usc/42/300j–21.md?p=6); and
  - (2) may be used to pay the costs of monitoring and reporting of lead levels in the drinking water of [schools](/usc/42/300j–21.md?p=6) of a [local educational agency](/usc/42/300j–21.md?p=3) receiving such funds, as determined appropriate by the [Administrator](/usc/42/4005.md?p=1).
- (c) **Priority—** In awarding funds under the grant [program](/usc/42/274l–1.md?p=4), the [Administrator](/usc/42/4005.md?p=1) shall give priority to [local educational agencies](/usc/42/300j–21.md?p=3) based on economic need.
- (d) **Authorization of appropriations—** There are authorized to be appropriated to carry out this section $5,000,000 for each of fiscal years 2019 through 2021.
