# §300ff–81. Coordination

- (a) **Requirement—** The [Secretary](/usc/42/201.md?p=c) shall ensure that the Health Resources and [Services](/usc/42/201.md?p=a) Administration, the Centers for Disease Control and Prevention, the Substance Abuse and Mental Health [Services](/usc/42/201.md?p=a) Administration, and the Centers for Medicare & Medicaid [Services](/usc/42/201.md?p=a) coordinate the planning, funding, and implementation of Federal [HIV](/usc/42/300ff–88.md?p=6) [programs](/usc/42/274l–1.md?p=4) (including all minority [AIDS](/usc/42/300ff–88.md?p=1) initiatives of the Public Health [Service](/usc/42/201.md?p=a), including under [section 300ff–121 of this title](/usc/42/300ff–121.md)) to enhance the continuity of care and [prevention services](/usc/42/300z–1.md?p=a-8) for individuals with [HIV/AIDS](/usc/42/300ff–88.md?p=7-A) or those at risk of such disease. The [Secretary](/usc/42/201.md?p=c) shall consult with other Federal [agencies](/usc/42/8262.md?p=1), including the Department of Veterans Affairs, as needed and utilize planning information submitted to such [agencies](/usc/42/8262.md?p=1) by the [States](/usc/42/300ff–88.md?p=11-A) and entities eligible for assistance under this subchapter.
- (b) **Report—** The [Secretary](/usc/42/201.md?p=c) shall biennially prepare and submit to the appropriate committees of the Congress a report concerning the coordination efforts at the Federal, [State](/usc/42/300ff–88.md?p=11-A), and local levels described in this section, including a description of Federal barriers to [HIV](/usc/42/300ff–88.md?p=6) [program](/usc/42/274l–1.md?p=4) integration and a strategy for eliminating such barriers and enhancing the continuity of care and [prevention services](/usc/42/300z–1.md?p=a-8) for individuals with [HIV/AIDS](/usc/42/300ff–88.md?p=7-A) or those at risk of such disease.
- (c) **Integration by State—** As a condition of receipt of funds under this subchapter, a [State](/usc/42/300ff–88.md?p=11-A) shall provide assurances to the [Secretary](/usc/42/201.md?p=c) that health support [services](/usc/42/201.md?p=a) funded under this subchapter will be integrated with other such [services](/usc/42/201.md?p=a), that [programs](/usc/42/274l–1.md?p=4) will be coordinated with other available [programs](/usc/42/274l–1.md?p=4) (including Medicaid), and that the continuity of care and [prevention services](/usc/42/300z–1.md?p=a-8) of individuals with [HIV/AIDS](/usc/42/300ff–88.md?p=7-A) is enhanced.
- (d) **Integration by local or private entities—** As a condition of receipt of funds under this subchapter, a local government or private [nonprofit](/usc/42/300s–3.md?p=3) entity shall provide assurances to the [Secretary](/usc/42/201.md?p=c) that [services](/usc/42/201.md?p=a) funded under this subchapter will be integrated with other such [services](/usc/42/201.md?p=a), that [programs](/usc/42/274l–1.md?p=4) will be coordinated with other available [programs](/usc/42/274l–1.md?p=4) (including Medicaid), and that the continuity of care and [prevention services](/usc/42/300z–1.md?p=a-8) of individuals with [HIV](/usc/42/300ff–88.md?p=6) is enhanced.

### Amendments

2009—Pub. L. 111–87 repealed Pub. L. 109–415, § 703, and revived the provisions of this section as in effect on Sept. 30, 2009. See 2006 Amendment note and Effective Date of 2009 Amendment; Revival of Section note below.

2006—Pub. L. 109–415, § 703, which directed repeal of this section effective Oct. 1, 2009, was itself repealed by Pub. L. 111–87, § 2(a)(1), effective Sept. 30, 2009.
