# §300ff–24. Grants for home- and community-based care

- (a) **Uses—** A [State](/usc/42/201.md?p=f) may use amounts provided under a grant awarded under [section 300ff–21 of this title](/usc/42/300ff–21.md) to make grants under [section 300ff–22(b)(3)(J) of this title](/usc/42/300ff–22.md?p=b-3-J) to entities to—
  - (1) provide home- and community-based health [services](/usc/42/201.md?p=a) for individuals with HIV/AIDS pursuant to written plans of care prepared by a case management team, that shall include appropriate health care professionals, in such [State](/usc/42/201.md?p=f) for providing such [services](/usc/42/201.md?p=a) to such individuals;
  - (2) provide outreach [services](/usc/42/201.md?p=a) to individuals with HIV/AIDS, including those individuals in rural areas; and
  - (3) provide for the coordination of the provision of [services](/usc/42/201.md?p=a) under this section with the provision of HIV-related health [services](/usc/42/201.md?p=a), including specialty care and vaccinations for hepatitis co-infection, provided by public and private entities.
- (b) **Priority—** In awarding grants under [subsection (a)](#a), a [State](/usc/42/201.md?p=f) shall give priority to entities that provide assurances to the [State](/usc/42/201.md?p=f) that—
  - (1) such entities will participate in HIV care consortia if such consortia exist within the [State](/usc/42/201.md?p=f); and
  - (2) such entities will utilize amounts provided under such grants for the provision of home- and community-based [services](/usc/42/201.md?p=a) to low-income individuals with HIV/AIDS.
- (c) **“Home- and community-based health services” defined—** As used in [section 300ff–21 of this title](/usc/42/300ff–21.md), the term “home- and community-based health [services](/usc/42/201.md?p=a)”—
  - (1) means, with respect to an individual with HIV/AIDS, skilled health [services](/usc/42/201.md?p=a) furnished to the individual in the individual’s home pursuant to a written plan of care established by a case management team, that shall include appropriate health care professionals, for the provision of such [services](/usc/42/201.md?p=a) and items described in [paragraph (2)](#c-2);
  - (2) includes—
    - (A) durable medical equipment;
    - (B) home health aide [services](/usc/42/201.md?p=a) and personal [care services](/usc/42/300z–1.md?p=a-7) furnished in the home of the individual;
    - (C) day [treatment](/usc/42/11851.md?p=11) or other partial hospitalization [services](/usc/42/201.md?p=a);
    - (D) home intravenous and aerosolized [drug](/usc/42/11851.md?p=4) therapy (including prescription [drugs](/usc/42/11851.md?p=4) administered as part of such therapy);
    - (E) routine diagnostic testing administered in the home of the individual; and
    - (F) appropriate mental health, developmental, and rehabilitation [services](/usc/42/201.md?p=a); and
  - (3) does not include—
    - (A) inpatient [hospital](/usc/42/300s–3.md?p=1) [services](/usc/42/201.md?p=a); and
    - (B) nursing home and other long term care facilities.

### Amendments

2009—Pub. L. 111–87 repealed Pub. L. 109–415, § 703, and revived the provisions of this section as in effect on Sept. 30, 2009. See 2006 Amendment note and Effective Date of 2009 Amendment; Revival of Section note below.

2006—Pub. L. 109–415, § 703, which directed repeal of this section effective Oct. 1, 2009, was itself repealed by Pub. L. 111–87, § 2(a)(1), effective Sept. 30, 2009.

Pub. L. 109–415, § 702(3), substituted “HIV/AIDS” for “HIV disease” wherever appearing.

Subsec. (a). Pub. L. 109–415, § 204(a), substituted “section 300ff–21 of this title” for “this part” in introductory provisions.

For provisions that repeal by section 2(a)(1) of Pub. L. 111–87 of section 703 of Pub. L. 109–415 be effective Sept. 30, 2009, and that the provisions of this section as in effect on Sept. 30, 2009, be revived, see section 2(a)(2), (3)(A) of Pub. L. 111–87, set out as a note under section 300ff–11 of this title.
