# §300ff–140. Applicability of part


This part shall not apply in a [State](/usc/42/201.md?p=f) if the chief executive officer of the [State](/usc/42/201.md?p=f) certifies to the [Secretary](/usc/42/201.md?p=c) that the law of the [State](/usc/42/201.md?p=f) is substantially consistent with this part.
