# §300d–4. Emergency medical services

- (a) **Federal Interagency Committee on Emergency Medical Services—**
  - (1) **Establishment—** The [Secretary](/usc/42/201.md?p=c) of Transportation, the [Secretary](/usc/42/201.md?p=c) of Health and Human [Services](/usc/42/201.md?p=a), and the [Secretary](/usc/42/201.md?p=c) of Homeland Security, acting through the Under [Secretary](/usc/42/201.md?p=c) for Emergency Preparedness and Response, shall establish a Federal Interagency Committee on Emergency Medical [Services](/usc/42/201.md?p=a).
  - (2) **Membership—** The Interagency Committee shall consist of the following officials, or their designees:
    - (A) The [Administrator](/usc/42/4005.md?p=1), National Highway Traffic Safety Administration.
    - (B) The [Director](/usc/42/11851.md?p=5), Preparedness Division, Directorate of Emergency Preparedness and Response of the Department of Homeland Security.
    - (C) The [Administrator](/usc/42/4005.md?p=1), Health Resources and [Services](/usc/42/201.md?p=a) Administration, Department of Health and Human [Services](/usc/42/201.md?p=a).
    - (D) The [Director](/usc/42/11851.md?p=5), Centers for Disease Control and Prevention, Department of Health and Human [Services](/usc/42/201.md?p=a).
    - (E) The [Administrator](/usc/42/4005.md?p=1), United States Fire Administration, Directorate of Emergency Preparedness and Response of the Department of Homeland Security.
    - (F) The [Administrator](/usc/42/4005.md?p=1), Centers for Medicare and Medicaid [Services](/usc/42/201.md?p=a), Department of Health and Human [Services](/usc/42/201.md?p=a).
    - (G) The Under [Secretary](/usc/42/201.md?p=c) of Defense for Personnel and Readiness.
    - (H) The [Director](/usc/42/11851.md?p=5), Indian Health [Service](/usc/42/201.md?p=a), Department of Health and Human [Services](/usc/42/201.md?p=a).
    - (I) The Chief, Wireless Telecommunications Bureau, Federal Communications Commission.
    - (J) A representative of any other Federal [agency](/usc/42/8262.md?p=1) appointed by the [Secretary](/usc/42/201.md?p=c) of Transportation or the [Secretary](/usc/42/201.md?p=c) of Homeland Security through the Under [Secretary](/usc/42/201.md?p=c) for Emergency Preparedness and Response, in consultation with the [Secretary](/usc/42/201.md?p=c) of Health and Human [Services](/usc/42/201.md?p=a), as having a significant role in relation to the purposes of the Interagency Committee.
    - (K) A [State](/usc/42/201.md?p=f) emergency medical [services](/usc/42/201.md?p=a) [director](/usc/42/11851.md?p=5) appointed by the [Secretary](/usc/42/201.md?p=c).
  - (3) **Purposes—** The purposes of the Interagency Committee are as follows:
    - (A) To ensure coordination among the Federal [agencies](/usc/42/8262.md?p=1) involved with [State](/usc/42/201.md?p=f), local, tribal, or regional emergency medical [services](/usc/42/201.md?p=a) and 9–1–1 systems.
    - (B) To identify [State](/usc/42/201.md?p=f), local, tribal, or regional emergency medical [services](/usc/42/201.md?p=a) and 9–1–1 needs.
    - (C) To recommend new or expanded [programs](/usc/42/274l–1.md?p=4), including grant [programs](/usc/42/274l–1.md?p=4), for improving [State](/usc/42/201.md?p=f), local, tribal, or regional emergency medical [services](/usc/42/201.md?p=a) and implementing improved emergency medical [services](/usc/42/201.md?p=a) communications technologies, including wireless 9–1–1.
    - (D) To identify ways to streamline the process through which Federal [agencies](/usc/42/8262.md?p=1) support [State](/usc/42/201.md?p=f), local, tribal or regional emergency medical [services](/usc/42/201.md?p=a).
    - (E) To assist [State](/usc/42/201.md?p=f), local, tribal or regional emergency medical [services](/usc/42/201.md?p=a) in setting priorities based on identified needs.
    - (F) To advise, consult, and make recommendations on matters relating to the implementation of the coordinated [State](/usc/42/201.md?p=f) emergency medical [services](/usc/42/201.md?p=a) [programs](/usc/42/274l–1.md?p=4).
  - (4) **Administration—** The [Administrator](/usc/42/4005.md?p=1) of the National Highway Traffic Safety Administration, in cooperation with the [Administrator](/usc/42/4005.md?p=1) of the Health Resources and [Services](/usc/42/201.md?p=a) Administration of the Department of Health and Human [Services](/usc/42/201.md?p=a) and the [Director](/usc/42/11851.md?p=5) of the Preparedness Division, Directorate of Emergency Preparedness and Response of the Department of Homeland Security, shall provide administrative support to the Interagency Committee, including scheduling meetings, setting agendas, keeping minutes and records, and producing reports.
  - (5) **Leadership—** The members of the Interagency Committee shall select a chairperson of the Committee each year.
  - (6) **Meetings—** The Interagency Committee shall meet as frequently as is determined necessary by the chairperson of the Committee.
  - (7) **Annual reports—** The Interagency Committee shall prepare an annual report to Congress regarding the Committee’s activities, actions, and recommendations.
- (b) **National Emergency Medical Services Advisory Council—**
  - (1) **Establishment—** The [Secretary](/usc/42/201.md?p=c) of Transportation, in coordination with the [Secretary](/usc/42/201.md?p=c) of Health and Human [Services](/usc/42/201.md?p=a) and the [Secretary](/usc/42/201.md?p=c) of Homeland Security, shall establish a National Emergency Medical [Services](/usc/42/201.md?p=a) [Advisory Council](/usc/42/274l–1.md?p=1) (referred to in this subsection as the “[Advisory Council](/usc/42/274l–1.md?p=1)”).
  - (2) **Membership—** The [Advisory Council](/usc/42/274l–1.md?p=1) shall be composed of 25 members, who—
    - (A) shall be appointed by the [Secretary](/usc/42/201.md?p=c) of Transportation; and
    - (B) shall collectively be representative of all sectors of the emergency medical [services](/usc/42/201.md?p=a) community.
  - (3) **Purposes—** The purposes of the [Advisory Council](/usc/42/274l–1.md?p=1) are to advise and consult with—
    - (A) the Federal Interagency Committee on Emergency Medical [Services](/usc/42/201.md?p=a) on matters relating to emergency medical [services](/usc/42/201.md?p=a) issues; and
    - (B) the [Secretary](/usc/42/201.md?p=c) of Transportation on matters relating to emergency medical [services](/usc/42/201.md?p=a) issues affecting the Department of Transportation.
  - (4) **Administration—** The [Administrator](/usc/42/4005.md?p=1) of the National Highway Traffic Safety Administration shall provide administrative support to the [Advisory Council](/usc/42/274l–1.md?p=1), including scheduling meetings, setting agendas, keeping minutes and records, and producing reports.
  - (5) **Leadership—** The members of the [Advisory Council](/usc/42/274l–1.md?p=1) shall annually select a chairperson of the [Advisory Council](/usc/42/274l–1.md?p=1).
