# §291j–9. Eligibility for grants


Funds appropriated pursuant to [section 291j–8 of this title](/usc/42/291j–8.md) shall be available for grants by the [Secretary](/usc/42/201.md?p=c) for not to exceed 50 per centum of the cost of [construction](/usc/42/300s–3.md?p=7) or [modernization](/usc/42/300s–3.md?p=9) of emergency rooms of public or [nonprofit](/usc/42/300s–3.md?p=3) general [hospitals](/usc/42/300s–3.md?p=1), including provision or [replacement](/usc/42/300j–21.md?p=5) of medical transportation facilities. Such grants shall be made by the [Secretary](/usc/42/201.md?p=c) only after consultation with the [State agency](/usc/42/300s–3.md?p=12) designated in accordance with [section 291d(a)(1) of this title](/usc/42/291d.md?p=a-1). In order to be eligible for a grant under this part, the [project](/usc/42/13641.md?p=2), and the applicant therefor, must meet such criteria as may be prescribed by [regulations](/usc/42/201.md?p=d). Such [regulations](/usc/42/201.md?p=d) shall be so designed as to provide aid only with respect to [projects](/usc/42/13641.md?p=2) for which adequate assistance is not readily available from other Federal, [State](/usc/42/201.md?p=f), local, or other sources, and to assist in providing modern, efficient, and effective emergency room [service](/usc/42/201.md?p=a) needed to care for victims of highway, industrial, agricultural, or other accidents and to handle other medical emergencies, and to assist in providing such [service](/usc/42/201.md?p=a) in geographical areas which have special need therefor.
