# §280c–2. General provisions

- (a) **Limitation on administrative expenses—** The [Secretary](/usc/42/201.md?p=c) may not make a grant under [section 280c(a) of this title](/usc/42/280c.md?p=a) to a [State](/usc/42/201.md?p=f) unless the [State](/usc/42/201.md?p=f) agrees that not more than 10 percent of the grant will be expended for administrative expenses with respect to the grant.
- (b) **Description of intended use of grant—** The [Secretary](/usc/42/201.md?p=c) may not make a grant under [section 280c(a) of this title](/usc/42/280c.md?p=a) to a [State](/usc/42/201.md?p=f) unless—
  - (1) the [State](/usc/42/201.md?p=f) submits to the [Secretary](/usc/42/201.md?p=c) a description of the purposes for which the [State](/usc/42/201.md?p=f) intends to expend the grant; and
  - (2) such description provides information relating to the [programs](/usc/42/274l–1.md?p=4) and activities to be supported and [services](/usc/42/201.md?p=a) to be provided, including—
    - (A) the number of individuals who will receive [services](/usc/42/201.md?p=a) pursuant to [section 280c(a) of this title](/usc/42/280c.md?p=a) and the average costs of providing such [services](/usc/42/201.md?p=a) to each such individual; and
    - (B) a description of the manner in which such [programs](/usc/42/274l–1.md?p=4) and activities will be coordinated with any similar [programs](/usc/42/274l–1.md?p=4) and activities of public and private entities.
- (c) **Requirement of application—** The [Secretary](/usc/42/201.md?p=c) may not make a grant under [section 280c(a) of this title](/usc/42/280c.md?p=a) to a [State](/usc/42/201.md?p=f) unless the [State](/usc/42/201.md?p=f) has submitted to the [Secretary](/usc/42/201.md?p=c) an application for the grant. The application shall—
  - (1) contain the description of intended expenditures required in [subsection (b)](#b);
  - (2) with respect to carrying out the purpose for which the grant is to be made, provide assurances of compliance satisfactory to the [Secretary](/usc/42/201.md?p=c); and
  - (3) otherwise be in such form, be made in such manner, and contain such information and agreements as the [Secretary](/usc/42/201.md?p=c) determines to be necessary to carry out this subpart.
- (d) **Evaluations and report by Secretary—** The [Secretary](/usc/42/201.md?p=c) shall—
  - (1) provide for an evaluation of each demonstration [project](/usc/42/13641.md?p=2) for which a grant is made under [section 280c(a) of this title](/usc/42/280c.md?p=a); and
  - (2) not later than 6 months after the completion of such evaluations, submit to the Congress a report describing the findings made as a result of the evaluations.
- (e) **Authorizations of appropriations—** For the purpose of carrying out this subpart, there are authorized to be appropriated $5,000,000 for each of the fiscal years 1988 through 1990, $7,500,000 for fiscal year 1991, and such sums as may be necessary for each of the fiscal years 1992 and 1993.

L. 91–212, §§ 2(g), 8, 10(c)(3), (d)(2)(A), 84 Stat. 63, 65, 67; June 18, 1973, Pub. L. 93–45, title I, § 107(f), 87 Stat. 92; renumbered § 397 and amended July 23, 1974, Pub. L. 93–353, title II, §§ 203(e), 204, 88 Stat. 372, 373, which related to grants to provide support for biomedical scientific publications, was classified to section 280b–9 of this title, prior to repeal by Pub. L. 99–158, § 3(b), Nov. 20, 1985, 99 Stat. 879.

### Amendments

1990—Subsec. (e). Pub. L. 101–557 substituted “there are” for “there is” and inserted before period at end “, $7,500,000 for fiscal year 1991, and such sums as may be necessary for each of the fiscal years 1992 and 1993”.
