# §2000gg–1. Nondiscrimination with regard to reasonable accommodations related to pregnancy


It shall be an unlawful employment practice for a [covered entity](/usc/42/2000gg.md?p=2) to—

- (1) not make [reasonable accommodations](/usc/42/2000gg.md?p=7) to the [known limitations](/usc/42/2000gg.md?p=4) related to the pregnancy, childbirth, or related medical conditions of a [qualified employee](/usc/42/2000gg.md?p=6), unless such [covered entity](/usc/42/2000gg.md?p=2) can demonstrate that the accommodation would impose an [undue hardship](/usc/42/2000gg.md?p=7) on the operation of the business of such [covered entity](/usc/42/2000gg.md?p=2);
- (2) require a [qualified employee](/usc/42/2000gg.md?p=6) affected by pregnancy, childbirth, or related medical conditions to accept an accommodation other than any [reasonable accommodation](/usc/42/2000gg.md?p=7) arrived at through the interactive process referred to in [section 2000gg(7) of this title](/usc/42/2000gg.md?p=7);
- (3) deny employment opportunities to a [qualified employee](/usc/42/2000gg.md?p=6) if such denial is based on the need of the [covered entity](/usc/42/2000gg.md?p=2) to make [reasonable accommodations](/usc/42/2000gg.md?p=7) to the [known limitations](/usc/42/2000gg.md?p=4) related to the pregnancy, childbirth, or related medical conditions of the [qualified employee](/usc/42/2000gg.md?p=6);
- (4) require a [qualified employee](/usc/42/2000gg.md?p=6) to take leave, whether paid or unpaid, if another [reasonable accommodation](/usc/42/2000gg.md?p=7) can be provided to the [known limitations](/usc/42/2000gg.md?p=4) related to the pregnancy, childbirth, or related medical conditions of the [qualified employee](/usc/42/2000gg.md?p=6); or
- (5) take adverse action in terms, conditions, or privileges of employment against a [qualified employee](/usc/42/2000gg.md?p=6) on account of the [employee](/usc/42/2000gg.md?p=3) requesting or using a [reasonable accommodation](/usc/42/2000gg.md?p=7) to the [known limitations](/usc/42/2000gg.md?p=4) related to the pregnancy, childbirth, or related medical conditions of the [employee](/usc/42/2000gg.md?p=3).
