# §1864a. Deputy Director of the Foundation


There shall be a Deputy [Director](/usc/42/11851.md?p=5) of the Foundation (referred to in this chapter as the “Deputy [Director](/usc/42/11851.md?p=5)”), who shall be appointed by the President, by and with the advice and consent of the Senate. Before any person is appointed as Deputy [Director](/usc/42/11851.md?p=5), the President shall afford the Board and the [Director](/usc/42/11851.md?p=5) an opportunity to make recommendations to him with respect to such appointment. The Deputy [Director](/usc/42/11851.md?p=5) shall receive basic pay at the rate provided for level III of the Executive Schedule under [section 5314 of title 5](/usc/5/5314.md), and shall perform such duties and exercise such powers as the [Director](/usc/42/11851.md?p=5) may prescribe. The Deputy [Director](/usc/42/11851.md?p=5) shall act for, and exercise the powers of, the [Director](/usc/42/11851.md?p=5) during the absence or disability of the [Director](/usc/42/11851.md?p=5) or in the event of a vacancy in the office of [Director](/usc/42/11851.md?p=5).
