# §17157. Review and evaluation

- (a) **In general—** The [Secretary](/usc/42/17001.md?p=3) may review and evaluate the performance of any [eligible entity](/usc/42/17151.md?p=1) that receives a grant under the [program](/usc/42/17151.md?p=5), including by conducting an audit, as the [Secretary](/usc/42/17001.md?p=3) determines to be appropriate.
- (b) **Withholding of funds—** The [Secretary](/usc/42/17001.md?p=3) may withhold from an [eligible entity](/usc/42/17151.md?p=1) any portion of a grant to be provided to the [eligible entity](/usc/42/17151.md?p=1) under the [program](/usc/42/17151.md?p=5) if the [Secretary](/usc/42/17001.md?p=3) determines that the [eligible entity](/usc/42/17151.md?p=1) has failed to achieve compliance with—
  - (1) any applicable guideline or regulation of the [Secretary](/usc/42/17001.md?p=3) relating to the [program](/usc/42/17151.md?p=5), including the misuse or misappropriation of funds provided under the [program](/usc/42/17151.md?p=5); or
  - (2) the energy efficiency and conservation strategy of the [eligible entity](/usc/42/17151.md?p=1).
