# §1437aaa–7. Limitation on selection criteria


In establishing criteria for selecting [applicants](/usc/42/1437aaa–5.md?p=1) to receive assistance under this subchapter, the [Secretary](/usc/42/242q–4.md?p=2) may not establish any selection criterion or criteria that grant or deny such assistance to an [applicant](/usc/42/1437aaa–5.md?p=1) (or have the effect of granting or denying assistance) based on the implementation, continuation, or discontinuation of any public policy, regulation, or law of any jurisdiction in which the [applicant](/usc/42/1437aaa–5.md?p=1) or [project](/usc/42/13641.md?p=2) is located.
