# §1397c. State reporting requirements


Prior to expenditure by a [State](/usc/42/619.md?p=5) of payments made to it under [section 1397a of this title](/usc/42/1397a.md) for any [fiscal year](/usc/42/619.md?p=3), the [State](/usc/42/619.md?p=5) shall report on the intended use of the payments the [State](/usc/42/619.md?p=5) is to receive under this division, [including](/usc/42/1301.md?p=b) information on the types of activities to be supported and the categories or characteristics of individuals to be served. The report shall be transmitted to the [Secretary](/usc/42/1301.md?p=a-6) and made public within the [State](/usc/42/619.md?p=5) in such manner as to facilitate comment by any [person](/usc/42/1301.md?p=a-3) ([including](/usc/42/1301.md?p=b) any Federal or other [public agency](/usc/42/11851.md?p=8)) during development of the report and after its completion. The report shall be revised throughout the year as may be necessary to reflect substantial changes in the activities assisted under this division, and any revision shall be subject to the requirements of the previous sentence.

L. 96–272, title II, § 206(a), (b), 94 Stat. 525, related to services program planning, prior to the general revision of this subchapter by section 2352(a) of Pub. L. 97–35.

### Amendments

2010—Pub. L. 111–148, which directed substitution of “this division” for “this subchapter” wherever appearing in subtitle 1 of title XX of act Aug. 14, 1935, was executed by making the substitution in two places in this section, which is in subtitle A of title XX act Aug. 14, 1935, to reflect the probable intent of Congress.
