# §13283. Discount payments

- (a) **Certification—** The [Secretary](/usc/42/242q–4.md?p=2) shall provide a [discount payment](/usc/42/13271.md?p=3) to a [proposer](/usc/42/13271.md?p=10) of a proposal selected under this part for purposes of reimbursing the [proposer](/usc/42/13271.md?p=10) for a discount provided to the users if the [proposer](/usc/42/13271.md?p=10) certifies to the [Secretary](/usc/42/242q–4.md?p=2) that—
  - (1) the [electric motor vehicles](/usc/42/13271.md?p=4) have been purchased or leased by a user or users in accordance with the requirements of this part; and
  - (2) the [proposer](/usc/42/13271.md?p=10) has provided to the user or users a [discount payment](/usc/42/13271.md?p=3) in accordance with the requirements of this part.
- (b) **Payment—** Not later than 30 days after receipt from the [proposer](/usc/42/13271.md?p=10) of [certification](/usc/42/13491.md?p=b-4) that the [Secretary](/usc/42/242q–4.md?p=2) determines satisfies the requirements of [subsection (a)](#a), the [Secretary](/usc/42/242q–4.md?p=2) shall pay to the [proposer](/usc/42/13271.md?p=10) the full amount of the [discount payment](/usc/42/13271.md?p=3), to the extent provided in advance in appropriations Acts.
- (c) **Calculations of discount payments—**
  - (1) The [discount payment](/usc/42/13271.md?p=3) shall be no greater than—
    - (A) the [price differential](/usc/42/13271.md?p=11); or
    - (B) the price of the [comparable conventionally fueled motor vehicle](/usc/42/13211.md?p=4).
  - (2) The purchase price of the [electric motor vehicle](/usc/42/13271.md?p=4), less the [discount payment](/usc/42/13271.md?p=3) and less any additional reduction in the purchase price of the [electric motor vehicle](/usc/42/13271.md?p=4) that may result from contributions provided by other parties, may not be less than the manufacturer’s suggested retail price of a [comparable conventionally fueled motor vehicle](/usc/42/13211.md?p=4).
  - (3) The maximum [discount payment](/usc/42/13271.md?p=3) shall be no greater than $10,000 per [electric motor vehicle](/usc/42/13271.md?p=4).
