# §13259. Secretary’s recommendations to Congress

- (a) **Recommendations to require availability or acquisition—** If the [Secretary](/usc/42/242q–4.md?p=2) determines, under [section 13257(f) of this title](/usc/42/13257.md?p=f), that a [fleet](/usc/42/13211.md?p=9) requirement program under [section 13257 of this title](/usc/42/13257.md) is not necessary, the [Secretary](/usc/42/242q–4.md?p=2) shall so notify the Congress. If the [Secretary](/usc/42/242q–4.md?p=2) so notifies the Congress, the [Secretary](/usc/42/242q–4.md?p=2) shall, within 2 years after such notification and by rule, prepare and submit to the Congress recommendations for requirements or incentives for—
  - (1) [fuel suppliers](/usc/42/13211.md?p=10) to make available to the public [replacement fuels](/usc/42/13211.md?p=14), including providing for the [construction](/usc/42/300s–3.md?p=7) or availability of related fuel delivery systems;
  - (2) suppliers of [alternative fueled vehicles](/usc/42/13211.md?p=3-A) to make available to the public [alternative fueled vehicles](/usc/42/13211.md?p=3-A) and to ensure the availability of necessary related services; and
  - (3) [motor vehicle](/usc/42/13211.md?p=13) drivers to use [replacement fuels](/usc/42/13211.md?p=14),

  to the extent necessary to achieve such goals of [replacement fuel](/usc/42/13211.md?p=14) use and to ensure that the availability of [alternative fuels](/usc/42/13211.md?p=2) and of [alternative fueled vehicles](/usc/42/13211.md?p=3-A) are consistent with each other.

- (b) **Fair and equitable application—** In carrying out this section, the [Secretary](/usc/42/242q–4.md?p=2) shall recommend the imposition of requirements proportionately on all appropriate [fuel suppliers](/usc/42/13211.md?p=10) and purchasers of [motor fuels](/usc/42/13211.md?p=12) and suppliers and purchasers of [motor vehicles](/usc/42/13211.md?p=13) in a fair and equitable manner.
