# §12841. Nonapplicability of certain requirements for small projects


Notwithstanding any other provision of law, the requirements of [section 1701u of title 12](/usc/12/1701u.md), and any implementing regulations or guidance, shall not apply to an activity assisted under this subchapter that involves rehabilitation, [construction](/usc/42/300s–3.md?p=7), or other development of [housing](/usc/42/12704.md?p=8) if—

- (1) the [recipient](/usc/42/12876.md?p=8) of assistance under this subchapter is—
  - (A) a [State](/usc/42/12704.md?p=2) [recipient](/usc/42/12876.md?p=8) pursuant to [section 12746 of this title](/usc/42/12746.md); or
  - (B) a [participating jurisdiction](/usc/42/12704.md?p=4) that received a total [allocation](/usc/42/2021b.md?p=2) of less than $3,000,000 in the most recent fiscal year pursuant to [section 12746 of this title](/usc/42/12746.md); and
- (2) the total number of dwelling units assisted as a part of such activity is not more than 50.
