# §12754. Limitation on jurisdictions under court order

- (a) **In general—** Notwithstanding any other provision of this Act, the [Secretary](/usc/42/12704.md?p=16) shall ensure that funds provided under this part are not employed to carry out [housing](/usc/42/12704.md?p=8) remedies or to pay fines, penalties, or costs associated with an action in which—
  - (1) a [participating jurisdiction](/usc/42/12704.md?p=4) has been adjudicated, by a Federal, [State](/usc/42/12704.md?p=2), or local court, to be in [violation](/usc/42/2000e–16a.md?p=c) of title VI of the Civil Rights Act of 1964 [[42 U.S.C. 2000d](/usc/42/2000d.md) et seq.], the Fair Housing Act [[42 U.S.C. 3601](/usc/42/3601.md) et seq.], or any other Federal, [State](/usc/42/12704.md?p=2), or local law promoting fair [housing](/usc/42/12704.md?p=8) or prohibiting discrimination, or
  - (2) a settlement has been entered into in any case where claims of such [violations](/usc/42/2000e–16a.md?p=c) have been asserted against a [participating jurisdiction](/usc/42/12704.md?p=4), except to the extent permitted by [subsection (b)](#b).
- (b) **Remedial use of funds permitted—** In the case of settlement described in [subsection (a)(2)](#a-2), a [jurisdiction](/usc/42/12704.md?p=3) may use funds provided under this Act to carry out [housing](/usc/42/12704.md?p=8) remedies with eligible activities.
