# §12615. National Civilian Community Corps

- (a) **Director—** Upon the establishment of the National Civilian Community [Corps](/usc/42/12626.md?p=3) [Program](/usc/42/12626.md?p=8), the National Civilian Community [Corps](/usc/42/12626.md?p=3) shall be under the direction of the [Director](/usc/42/12626.md?p=6) appointed pursuant to [section 12619(c)(1) of this title](/usc/42/12619.md?p=c-1).
- (b) **Membership in National Civilian Community Corps—**
  - (1) **Participants to be members—** Persons selected to participate in the national service [program](/usc/42/12626.md?p=8) or the summer national service [program](/usc/42/12626.md?p=8) components of the [Program](/usc/42/12626.md?p=8) shall become members of the National Civilian Community [Corps](/usc/42/12626.md?p=3).
  - (2) **Selection of members—** The [Director](/usc/42/12626.md?p=6) or the [Director](/usc/42/12626.md?p=6)’s designee shall select individuals for membership in the [Corps](/usc/42/12626.md?p=3).
  - (3) **Application for membership—** To be selected to become a [Corps](/usc/42/12626.md?p=3) member an individual shall submit an application to the [Director](/usc/42/12626.md?p=6) or to any other office as the [Director](/usc/42/12626.md?p=6) may designate, at such time, in such manner, and containing such information as the [Director](/usc/42/12626.md?p=6) shall require. At a minimum, the application shall contain information about the work experience of the applicant and sufficient information to enable the [Director](/usc/42/12626.md?p=6), or the [campus director](/usc/42/12626.md?p=2) of the appropriate campus, to determine whether selection of the applicant for membership in the [Corps](/usc/42/12626.md?p=3) is appropriate.
  - (4) **Team leaders—**
    - (A) **In general—** The [Director](/usc/42/12626.md?p=6) may select individuals with prior supervisory or service experience to be team leaders within [units](/usc/42/12626.md?p=10) in the National Civilian Community [Corps](/usc/42/12626.md?p=3), to perform service that includes leading and supervising teams of [Corps members](/usc/42/12626.md?p=5). Each team leader shall be selected without regard to the age limitation under [section 12613(b) of this title](/usc/42/12613.md?p=b).
    - (B) **Rights and benefits—** A team leader shall be provided the same rights and benefits applicable to other [Corps members](/usc/42/12626.md?p=5), except that the [Director](/usc/42/12626.md?p=6) may increase the limitation on the amount of the living allowance under [section 12618(b) of this title](/usc/42/12618.md?p=b) by not more than 10 percent for a team leader.
- (c) **Organization of Corps into units—**
  - (1) **Units—** The [Corps](/usc/42/12626.md?p=3) shall be divided into permanent [units](/usc/42/12626.md?p=10). Each [Corps](/usc/42/12626.md?p=3) member shall be assigned to a [unit](/usc/42/12626.md?p=10).
  - (2) **Unit leaders—** The leader of each [unit](/usc/42/12626.md?p=10) shall be selected from among persons in the permanent cadre established pursuant to [section 12619(c)(2) of this title](/usc/42/12619.md?p=c-2). The designated leader shall accompany the [unit](/usc/42/12626.md?p=10) throughout the period of agreed service of the members of the [unit](/usc/42/12626.md?p=10).
- (d) **Campuses—**
  - (1) **Units to be assigned to campuses—** The [units](/usc/42/12626.md?p=10) of the [Corps](/usc/42/12626.md?p=3) shall be grouped together as appropriate in campuses for operational, support, and boarding purposes. The [Corps campus](/usc/42/12626.md?p=4) for a [unit](/usc/42/12626.md?p=10) shall be in a facility or central location established as the operational headquarters and boarding place for the [unit](/usc/42/12626.md?p=10). [Corps members](/usc/42/12626.md?p=5) may be housed in the campuses.
  - (2) **Campus director—** There shall be a [campus director](/usc/42/12626.md?p=2) for each campus. The [campus director](/usc/42/12626.md?p=2) is the head of the campus.
  - (3) **Eligible site for campus—** A campus shall be cost effective and may, upon the completion of a feasibility study, be located in a facility referred to in [section 12622(c) of this title](/usc/42/12622.md?p=c).
- (e) **Distribution of units and campuses—** The [Director](/usc/42/12626.md?p=6) shall ensure that the [Corps](/usc/42/12626.md?p=3) [units](/usc/42/12626.md?p=10) and campuses are cost effective and are distributed in urban areas and rural areas such that each [Corps](/usc/42/12626.md?p=3) [unit](/usc/42/12626.md?p=10) in a region can be easily deployed for [disaster](/usc/42/5204.md?p=2) and emergency response to such region.
- (f) **Standards of conduct—**
  - (1) **In general—** The [campus director](/usc/42/12626.md?p=2) of each campus shall establish and enforce standards of conduct to promote proper moral and disciplinary conditions in the campus.
  - (2) **Sanctions—** Under procedures prescribed by the [Director](/usc/42/12626.md?p=6), the [campus director](/usc/42/12626.md?p=2) of a campus may—
    - (A) transfer a member of the [Corps](/usc/42/12626.md?p=3) in that campus to another [unit](/usc/42/12626.md?p=10) or campus if the [campus director](/usc/42/12626.md?p=2) determines that the retention of the member in the member’s [unit](/usc/42/12626.md?p=10) or in the [campus director](/usc/42/12626.md?p=2)’s campus will jeopardize the enforcement of the standards or diminish the opportunities of other [Corps members](/usc/42/12626.md?p=5) in that [unit](/usc/42/12626.md?p=10) or campus, as the case may be; or
    - (B) dismiss a member of the [Corps](/usc/42/12626.md?p=3) from the [Corps](/usc/42/12626.md?p=3) if the [campus director](/usc/42/12626.md?p=2) determines that retention of the member in the [Corps](/usc/42/12626.md?p=3) will jeopardize the enforcement of the standards or diminish the opportunities of other [Corps members](/usc/42/12626.md?p=5).
  - (3) **Appeals—** Under procedures prescribed by the [Director](/usc/42/12626.md?p=6), a member of the [Corps](/usc/42/12626.md?p=3) may appeal to the [Director](/usc/42/12626.md?p=6) a determination of a [campus director](/usc/42/12626.md?p=2) to transfer or dismiss the member. The [Director](/usc/42/12626.md?p=6) shall provide for expeditious disposition of appeals under this paragraph.
