# §12335. State plan

- (a) **Submission of plan—** The chief executive officer of a [State](/usc/42/12302.md?p=5), in order to be eligible for grants from an allotment under section [12337](/usc/42/12337.md), [12338](/usc/42/12338.md), or [12339](/usc/42/12339.md)[^1] of this title for any fiscal year, shall prepare and submit to the [Commissioner](/usc/42/12302.md?p=1) a [State](/usc/42/12302.md?p=5) plan for a 3-year period.
- (b) **Revisions of plan—** Each chief executive officer of a [State](/usc/42/12302.md?p=5) may make annual revisions of the [State](/usc/42/12302.md?p=5) plan referred to in [subsection (a)](#a).
- (c) **Content of plan—** The chief executive officer of a [State](/usc/42/12302.md?p=5) shall include within the [State](/usc/42/12302.md?p=5) plan of that [State](/usc/42/12302.md?p=5) assurances as required under sections[^2] 12337, 12338, or 12339[^1] of this title, and a description of the proposed multi-year plans of the [State](/usc/42/12302.md?p=5) for program development and implementation.
- (d) **Type of application—** A [State](/usc/42/12302.md?p=5) may apply for funds under one or more of the following categories:
  - (1) [section 12337 of this title](/usc/42/12337.md);
  - (2) sections [12337](/usc/42/12337.md) and [12338](/usc/42/12338.md) of this title jointly; or
  - (3) [section 12339](/usc/42/12339.md)[^1] of this title.

  In the case of each category, the [State](/usc/42/12302.md?p=5) application and plan shall comply only with the requirements of the appropriate section.

- (e) **Approval of plan—**
  - (1) **In general—** The [Commissioner](/usc/42/12302.md?p=1) shall approve any [State](/usc/42/12302.md?p=5) plan under sections [12337](/usc/42/12337.md) and [12338](/usc/42/12338.md) of this title that the [Commissioner](/usc/42/12302.md?p=1) determines meets the requirements of such sections.
  - (2) **Notice and opportunity to correct deficiencies—** The [Commissioner](/usc/42/12302.md?p=1) shall not make a final determination disapproving any [State](/usc/42/12302.md?p=5) plan, modifying such plan, or declaring a [State](/usc/42/12302.md?p=5) to be ineligible to receive funds under sections [12337](/usc/42/12337.md) and [12338](/usc/42/12338.md) of this title without previously affording such [State](/usc/42/12302.md?p=5) reasonable notice and opportunity to correct deficiencies in its application.
