# §10172. Selection of Yucca Mountain site

- (a) **In general—**
  - (1) The [Secretary](/usc/42/10101.md?p=20) shall provide for an orderly phase-out of site specific activities at all [candidate sites](/usc/42/10101.md?p=4) other than the [Yucca Mountain site](/usc/42/10101.md?p=30).
  - (2) The [Secretary](/usc/42/10101.md?p=20) shall terminate all site specific activities (other than reclamation activities) at all [candidate sites](/usc/42/10101.md?p=4), other than the [Yucca Mountain site](/usc/42/10101.md?p=30), within 90 days after December 22, 1987.
- (b) **Eligibility to enter into benefits agreement—** Effective on December 22, 1987, the [State](/usc/42/10101.md?p=24) of Nevada shall be eligible to enter into a benefits agreement with the [Secretary](/usc/42/10101.md?p=20) under [section 10173 of this title](/usc/42/10173.md).
